These Terms of Service ("Terms") govern your access to and use of the Apex Nursing platform, including all content, tools, features, and services made available through apex-nursing.com and any related applications ("Platform"). By accessing or using the Platform, you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use the Platform.

Apex Nursing is an educational platform. All content, tools, calculators, practice modules, reference materials, and other resources are provided for informational and educational purposes only.

Nothing on this Platform constitutes medical advice, clinical guidance, or a substitute for the judgment of a licensed healthcare professional. Some features of the Platform may require you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to provide accurate and current information when creating your account and to notify us promptly of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe present a risk to the Platform or its users.

You agree not to:

• Use the Platform for any unlawful purpose or in violation of applicable laws or regulations
• Attempt to gain unauthorized access to any part of the Platform or its systems
• Scrape, copy, or reproduce Platform content for commercial redistribution without permission
• Upload or transmit harmful code, malware, or disruptive content
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt the integrity or performance of the Platform
• Use the Platform in any manner that could harm, disparage, or create liability for Apex Nursing

All content on the Platform — including text, graphics, logos, training modules, illustrations, educational content, and software — is the property of Apex Nursing or its content licensors and is protected by applicable copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial educational purposes only. No content may be reproduced, distributed, modified, or used for commercial purposes without our express written permission.

If you submit, post, or otherwise provide content through the Platform (such as forum posts, study notes, comments, or other material), you grant Apex Nursing a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with operating and improving the Platform. You represent that you have the rights necessary to grant this license and that your submissions do not infringe any third-party rights or violate any applicable law.

Apex Nursing may introduce paid features, memberships, or subscriptions in the future. If and when paid services are offered, additional terms will apply and will be presented at the time of purchase. All purchases are subject to our refund and cancellation policy, which will be communicated at that time.

The Platform may contain links to third-party websites, tools, or services. We do not endorse, control, or take responsibility for the content or practices of any third-party sites. Accessing third-party content is at your own risk and subject to those parties' own terms and privacy policies.

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. We make no warranties regarding the accuracy, completeness, or suitability of any educational content for any specific purpose.

To the maximum extent permitted by applicable law, Apex Nursing and its operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to us, if any, in the twelve months preceding the claim.

You agree to indemnify, defend, and hold harmless Apex Nursing and its operators from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

We reserve the right to suspend or terminate your access to the Platform at any time, for any reason, including violations of these Terms. You may also discontinue use of the Platform at any time. Upon termination, provisions that by their nature should survive (including intellectual property, disclaimers, and limitations of liability) will remain in effect.

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict of law principles.

We may update these Terms as the Platform evolves. We will post revised Terms with an updated effective date. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. For significant changes, we may provide additional notice through the Platform or by email.
